Part I - Petition of Citizen or LPR

The first part of the process of obtaining a green card for a non- citizen requires the U.S. citizen (USC) or legal permanent resident (LPR) to submit a Petition to the USCIS

Form  -  I- 130 Petition

Evidence Required to Support an I-130 Petition

 a.  Proof of the status of the petitioner (USC or LPR):

  •      U.S. Birth Certificate; or
  •      Naturalization Certificate; or
  •      Green Card

 b. Proof of  the relationship to the non-citizen relative:

  • Marriage certificate; or
  • Birth certificate of relative, showing names of parents;
  • Divorce Decree (where there were previous marriages - to show eligibility of both spouses to marry)

 c. Humanitarian Reinstatement (“Substitution”)
